Prenuptial agreements can protect millennials during divorce

Getting divorced in California can be a particularly complex process for those who have been married for years and have amassed numerous assets. However, it can also be complicated for millennials, younger adults who may not have amassed as much cash and property. For this reason, prenuptial agreements can be helpful to create and sign prior to walking down the aisle.

The Pew Research Center reported that the rate of marriage in the United States is decreasing. In fact, only 26 percent of those in the millennial generation are married. However, marriages still do happen, so for those interested in getting hitched, it make sense to be prepared.

Many millennials consider prenuptial agreements to be estate planning tools, as they allow unmarried couples to discuss their assets and determine what will happen to them in the long run. These legal agreements are simply part of the planning and communication process to make sure that both parties' desires are met in the event that the marriage does not last. Rather than viewing prenuptial agreements as unromantic, many individuals from this generation view them as practical.

Those who never created a prenuptial agreement but find themselves going through divorce may still use a process such as divorce mediation or negotiation to determine how their assets should be split as part of the divorce. These processes are alternatives to traditional divorce litigation, which can be acrimonious and more costly. A qualified attorney in California can help with creating prenuptial agreements or offer guidance during negotiation or mediation to ensure that one's desires are pursued long term.
