What you can expect when filing a California divorce

Every day, California residents come to the heartbreaking decision that their marriages are ending. Once that decision is made, the parties usually have numerous questions about the divorce process. The legalities involved can be complex and frustrating, but failing to meet the obligations imposed by the court could be costly and time-consuming.

It makes good sense to seek the advice and assistance of an attorney as soon as possible. He or she should be able to answer your questions and help you through the process. For instance, there are only two grounds for divorce here in California. The first is irreconcilable differences, which means that the parties' relationship is beyond repair. The second is incurable insanity, which requires medical certification that the other spouse was and remains mentally compromised.

Additional requirements must also be met prior to filing. One of you must have been a resident of the state for at least six months. There are also measures that go into place once the petition is filed to prevent either party from taking certain actions. Everything is basically frozen until the divorce is finalized.

Your attorney can provide you with as little or as much assistance in preparing your divorce settlement as you need. Most courts encourage the parties to come to an agreement without the intervention of the court since the parties are often more satisfied with the outcome and the provisions can be tailored to the needs of the family. If you are contemplating ending your marriage, it would be in your best interest to seek legal advice to help ensure that everything goes as smoothly as possible.
