Divorce mediation offers couples alternatives to courtrooms

When marriages end, California couples may dread the possibility of ending up in courtrooms where the judges decide their fates. Fortunately, there is an alternative. Divorce mediation offers couples a way to settle their issues without the time, expense and emotional upheaval that contentious court battles often provide.

The mediator does not represent either party, so each spouse is encouraged to have his or her own counsel to review any agreement before it is signed -- at the very least. The mediator provides the parties with information, options and insight as to how a court would resolve the matter. He or she helps determine an appropriate resolution to an issue based on the needs of each individual family.

In many cases, it is necessary to obtain assistance from third parties, such as appraisers, financial consultants and even therapists, if needed. These third parties can help you and your spouse formulate an agreement that best serves each party. This does not necessarily mean that you will get everything you desire, but the atmosphere created during the mediation sessions is designed to encourage you and your partner to compromise when necessary. By the end, most couples walk away with agreements with which both are satisfied.

If you are contemplating a California divorce and do not want to end up starring in a courtroom drama, mediation could be the answer. An amicably reached divorce settlement could give you and your spouse better starts to your independent futures. In addition, if there are children involved, mediation often provides parents with a foundation for a more harmonious post-divorce relationship, which will benefit the whole family.
