Determining spousal support in a California divorce

When California couples divorce, a financial deficit of often created for one of the parties. For this reason, the law provides that spouse can receive spousal support. How the amount of support is calculated is not as simple as following the guidelines as judges ordinarily do in child support cases.

Of course, there are certain minimal requirements that judges take into consideration such as how long the parties were married. After that, the income of each party is taken into consideration, along with how the marital assets are divided. Once those factors are determined, the standard of living that the parties enjoyed during the marriage is also factored into the equation.

This formula might work for some California couples, but every couple is different. If the circumstances warrant it, the judge can adjust the amount up or down. In addition, the support can be either permanent or temporary based on the needs of the person receiving it. It will be up to the parties to provide evidence to the court that supports their position. Once the court has reviewed all of the evidence, an order will be entered that might deviate from the standard.
