Ben Affleck and Jennifer Garner rumored to use mediation

If you are a fan of gossip magazines, you are likely familiar with the sections that show celebrities doing things that most “normal” people do, such as grocery shopping, filling their cars with gas and even paying for parking. These “candid camera” like photos are included in the “just like us” sections of these magazines.

With the news of Ben Affleck and Jennifer Garner announcing their divorce and noting that they would be working with a mediator to resolve any property division, custody and parenting time concerns, another “just like us” example should be the use of mediation as an alternative dispute resolution process. 

For those unfamiliar with mediation, it is a meeting (or a series of them) with a third party neutral who helps divorcing parties reach a mutual decision regarding asset division, child custody and parenting time. Mediation has several benefits. For instance, it is not meant to determine who is right and who is wrong, so that one party can prevail over another. With that, mediation can help preserve important co-parenting relationships that children depend on.

Further, mediation is generally less expensive than traditional litigation, as there are no motion hearings to prepare for and no trial costs associated with the process. Finally, mediation can be quicker than litigation, as the parties will be on their own schedule instead of the court’s schedule. This way, a mediation is not bound to the limited instances the parties have to be before a family court judge.
