Divorce season begins just as the holidays end

Now that the holidays are winding down, the divorce season is just beginning. Lawyers across California and the United States as a whole report that divorce filings escalate during the month of January. Unhappy couples have suffered through the holidays and now decide that it is time to take action.

As one is deciding whether divorce is the best option, it is best to look at the situation from a business perspective rather than an emotional one. For some, divorce provides relief from a stressful, unhappy situation. For others, divorce is a financial burden. It is a good idea to take a look at the overall financial picture, including income, living expenses, health care, child care and more in deciding to file.

Once the decision to file for divorce is made, it is time gather financial records. While it is not recommended that a spouse open the other spouse's bank statements, a notation regarding the name of the bank can aid in obtaining the necessary data legally through the use of a subpoena. The accountant's office is also a good place to gather financial data that may be useful during the divorce proceedings.

During the holidays, many California couples spend time together as a family and with extended family. This time away from the everyday routine of normal life is often the catalyst for making the final decision to divorce. In making this decision, one wants to keep in mind the timing – parents do not want the children to associate a holiday with the divorce.
