California: Jay Mohr and Nikki Cox confronting their divorce

For many California couples, the decision to divorce is not an easy one. In addition to the emotional decisions that must be made, there are the family and financial ones too. Almost all parents facing divorce must find a way to decide how assets will be divided, who will have custody of the children, how much will be paid in child and spousal support and more.

The recent announcement of Jay Mohr and Nikki Cox's impending divorce highlights the various issues that must be considered. Fortunately, this couple has a prenuptial agreement in place. It is likely that this agreement specifically addresses the division of property and other assets. Reports indicate that this prenuptial agreement also contains a provision for spousal support.

Another issue to be decided is which parent will have custody of the children, or whether they share custody. It appears that Mohr is seeking custody of the children. According to his attorney, Mohr has concerns about his wife's ability to take care of their child. In a situation such as this, the couple is usually unable to come to an agreement and it is left up to the courts to make a final determination of which parent should have custody.

When it comes to making decisions regarding a divorce, most California couples find that it is necessary to push emotions aside and make decisions that are best for each individual and any children who are involved. This is often much easier said than done. Many times, divorcing couples find that it is easier to allow their attorneys to review the situation and negotiate the agreement.
