Mediation could be a better way to settle your family law issues

California couples are no longer restricted to sitting across a room at separate tables and allowing a judge to make decisions about their futures. They can now decide to use alternative methods of resolving their family law issues such as mediation. This allows the parties to work out their issues on their own, which -- if successful -- often ends with an agreement that the parties involved find satisfactory.

In mediation, divorcing couples take advantage of a mediator's knowledge of the law, court processes and typical judicial decisions regarding property division, child custody, spousal support and more. This way, the parties are able to make informed decisions as they work to resolve their issues. Agreements can be tailored to the needs of each individual family.

Negotiations can include considerations that might not be within the scope of a judge's discretion so long as they do not violate current law and public policy. Any disagreements are resolved among the parties instead of by a judge. The process encourages the parties to discuss their issues, present their ideas and come to a resolution that benefits their family. By taking ownership in the process, the parties are often more willing to follow the provisions of the agreement when the process is complete.
