Accusations of domestic violence need to be dealt with quickly

As a result of an increased awareness of the abuse that occurs in some California homes, law enforcement agencies take accusations of abuse seriously. Quick responses from police have undoubtedly saved a number of people, including children, from domestic violence. However, that same zeal can also embroil an innocent person in the criminal justice and civil court systems.

Many California residents are victims of abuse from someone that they trusted to love and protect them. Instead, those supposed loved ones physically and/or emotionally abuse their victims. For those victims who have gotten themselves -- and perhaps their children -- out of such a situation, a restraining order may help keep a potentially violent spouse or significant other from further abusive conduct. An attorney can help obtain a restraining order, which may also help keep a violent parent from having liberal visitation with the children.

On the other hand, some people accuse a loved one of being abusive in order to gain a tactical advantage during divorce or custody proceedings. Not only does this diminish the plight of real victims, but even an accusation of domestic abuse can have adverse effects on the other party. If this happens to you, engaging legal representation as quickly as possible could minimize the impact of an accusation and prove your innocence. These accusations can affect child custody, relocation of the children and other family law matters.

Domestic violence should never be tolerated, but accusations of abuse should not be used to disparage an innocent party. Regardless of whether you are a victim or accused of abuse, you deserve the best representation available to find a resolution to the situation. These and other family law issues require a knowledgeable yet compassionate approach during what is most likely a challenging and emotional time for the whole family.
